HEALTH GUARANTEE/ SALES CONTRACT

Umpqua Valley Kennels LLC extends the following warranties, guarantees only to the buyer below: We guarantee all papers on stated registered puppies. We guarantee all puppies to have had all treatments and vaccinations as stated on written health record. We make no guarantees of your puppy’s mature size, or that it will be show, or breeding quality.

As stated in Oregon Law 2470:

(2) Except as otherwise provided in this section, a pet dealer (seller) shall provide the purchaser of a dog that complies with subsection (3) of this section with a full refund of the purchase price for the dog if:

(a) No later than 15 days after purchasing the dog from the pet dealer the purchaser has the dog examined by a veterinarian and the examination reveals that the dog is diseased; or

(b) No later than one year after purchasing the dog from the pet dealer ( seller ) the purchaser has the dog examined by a veterinarian and the examination reveals that the dog has a congenital disorder that significantly limits the dog's quality of life.

(3) To qualify for a refund under this section, the purchaser, no later than four business days after the veterinary examination that revealed the disease or disorder, must:

(a) Return the dog to the pet dealer (seller);

(b) Provide the pet dealer with a dated written statement by the examining veterinarian that the dog has a disease or has a congenital defect; and

(4) Upon mutual agreement of the purchaser and pet dealer (seller), the purchaser may accept a replacement dog instead of a refund.

(5) A purchaser that complies with subsection (2) of this section may, instead of obtaining a refund, require that the pet dealer ( seller ) reimburse the purchaser for the cost of veterinary care provided in connection with the disease or congenital disorder described in subsection (2) of this section. The duty of the pet dealer (seller) to reimburse the purchaser for the cost of veterinary care shall be limited to the purchase price of the dog. A purchaser that agrees to accept reimbursement under this subsection waives any other claim against the pet dealer (seller) for reimbursement of the cost of veterinary care for the dog.

(6) Notwithstanding sub sections (1) to (5) of this section, a pet dealer (seller) is not required to refund the purchase price for a dog, provide a replacement dog or reimburse the purchaser for veterinary care if the pet dealer:

(a) At the time of sale made a clear and conspicuous disclosure in writing, initialed or signed by the purchaser, that disclosed the disease or disorder; or

(b) Had the dog examined by a veterinarian not more than 14 days prior to the date of sale and the examination did not disclose the disease or congenital disorder.

By signing this agreement you as the buyer are also acknowledging that you accept total responsibility for the special care that may be needed for the very tiny Chihuahuas that may experience hypoglycemia. Treatment for this condition can be quite expensive, but is almost always totally preventable if proper care instructions are followed. This is extremely serious and can result in disability or death for the puppy. Event/stress induced Hypoglycemia is NOT covered by this contract.

We encourage purchasers to take advantage of the additional health warranty offer that is in your puppy starter pack and featured on our website. We have also included information in your pack on pet health insurance.

By signing this contract you are agreeing that it is your responsibility to place this puppy in a new, appropriate home, regardless of financial compensation if :

1. The puppy does not “bond” with you or your family (including other pets)

2. Your living situation changes and you are no longer able to have pets.

3. You change your mind for any reason and do not wish to have the puppy as part of your family.

We are more than happy to assist you with advice on how to do this and pass on contacts of anyone who may be interested in adopting your puppy. Actual screening and agreement of adoption is up to you. Surrendering this puppy/dog to a shelter or rescue must NEVER happen.

It is also your responsibility to safe guard your puppy’s health and obtain medical treatments for it when needed. We are extremely diligent in our protection and care of them from birth to the time they come to be your puppy and have done everything humanly possible to ensure they are healthy and well adjusted.

All sales are final and irreversible with the only exceptions being those as stated above.

Both the seller and the buyer agree that this contract and sale of this puppy is under the jurisdiction of the state of Oregon, the county of Douglas.
